INFORMATIVA SUL TRATTAMENTO DEI DATI DEGLI UTENTI CHE SI REGISTRANO PER ADERIRE A RISE UP COMMUNITY APS
ai sensi dell’articolo 13 del Regolamento (UE) 2016/67
Titolare del trattamento è Rise Up Community APS con sede legale in Via Chiabrera 7/11b – 16123 Genova.
Per diventare SOCIO l’utente compila il format di registrazione presente sul sito www.riseupcommunity.it (“diventa soci* di Rise Up”) comunicando i suoi dati anagrafici e di contatto.
L’’utente è responsabile della veridicità dei dati inseriti.
Le attività di trattamento dei dati del socio sono eserciate da incaricati dell’ associazione, autorizzati dal titolare, ai sensi dell’articolo 2 quaterdecies del Dlgs 196/2003, che operano nel rispetto degli specifici compiti assegnati .
La adesione alla associazione è la base giuridica del trattamento, pertanto i dati registrati dal sistema sono necessari per dare corso alla richiesta di iscrizione. Il conferimento dei dati è pertanto obbligatorio per organizzare tutte le attività funzionali alla richiesta di adesione; adempimenti amministrativi e contabili previsti dalla legislazione vigente, gestione del socio, informazione sul bilancio e le attività associative, campagne di tesseramento, campagne 5×1000.
Il socio può invece negare il suo consenso a specifiche attività di trattamento non direttamente connesse al rapporto associativo come:
la profilazione che prevede l’analisi di aspetti e comportamenti del socio nei confronti dell’associazione utili a valutare la efficacia delle scelte operate dal titolare nell’ambito dei propri scopi sociali;
l’invio della newsletter di Rise Up. Uno strumento di comunicazione che Rise Up vuole rivolgere a tutti i suoi contatti, compresi gli iscritti e donatori, per informare su eventi, iniziative, progetti, campagne sociali e tante altre attività promosse dall’associazione;
In assenza del consenso esplicito da parte dell’interessato, Rise Up non eserciterà tali trattamenti .
I dati non saranno trasferiti all’estero ma potranno essere comunicati ai coordinatori della regione e del territorio dove risiede il socio, per consentire la sua partecipazione alla vita associativa locale (assemblee, eventi pubblici, seminari, convegni).
In ogni caso i dati non saranno diffusi a terzi soggetti indeterminati, ma potranno essere comunicati – esclusivamente per le finalità di cui sopra – a fornitori di servizi che saranno debitamente nominati responsabili del trattamento.
Questi soggetti, selezionati da Rise Up Community in base alle specifiche competenze e alle garanzie di tutela dei dati e di riservatezza, possono accedere ai dati in forza di normative o di disposizioni di legge o per finalità e compiti ausiliari al rapporto intercorrente fra il socio e Rise Up (ad esempio: manutentori del sistema informatico, tipografi, spedizionieri, istituti di credito, istituzioni pubbliche).
Il periodo di conservazione dei dati è connesso alla durata del rapporto associativo e agli obblighi di legge connessi alle finalità amministrative e contabili.
Rise Up promuove e/ o partecipa a manifestazioni pubbliche durante le quali vengono effettuate foto e riprese audio video che possono ritrarre, fra i partecipanti, i soci . Questi dati sono sempre raccolti in contesti pubblici collegati a fatti, avvenimenti, cerimonie di interesse pubblico o svolte in pubblico (’art. 9 par. 2) lettera e) e art. 85 Regolamento UE 2016/679, art. 97 legge n. 633/ 1941)
E’ dovere del titolare informare che una manifestazione prevede che nel momento in cui ci si espone al pubblico, specie se in un luogo aperto, si accetta di poter essere fotografati ovvero ripresi, e l’utilizzazione delle immagini è sempre possibile per scopi informativi (diritto di cronaca) e per interesse pubblico all’informazione. Rise Up Community eserciterà I trattamenti connessi a questi dati sempre in contesti non lesivi dignità della persona e per finalità di divulgazione, come a titolo esemplificativo ma non esaustivo : pubblicazione sul sito di Rise Up Community, social network, realizzazione di materiale stampato, diffusione alle testate giornalistiche per attività di ufficio stampa, altre attività utili e funzionali al perseguimento di dette finalità.
Il socio può esercitare tutti i diritti previsti dalla privacy policy (accesso, comunicazione della loro origine, logica applicata in caso di trattamento con strumenti elettronici, cancellazione, trasformazione in forma anonima, blocco dei dati , aggiornamento, rettificazione, integrazione) rivolgendosi al Responsabile della Protezione dei Dati (RPD) c/o Rise Up Community. In ogni caso il socio è sempre legittimato a proporre un reclamo presso l’Autorità di controllo italiana (Garante per la protezione dei dati personali).

Personal Data may be freely provided by the User or, in the case of Usage Data, collected automatically during the use of this Application.
Unless otherwise specified, all Data requested by this Application is mandatory. If the User refuses to provide it, this Application may be unable to provide the Service. In cases where this Application specifically states that some Data is optional, Users are free not to disclose such Data, without any consequences on the availability or functioning of the Service.

Any use of Cookies – or other tracking tools – by this Application or by the owners of third-party services used by this Application, unless otherwise stated, is for the purpose of providing the Service requested by the User, in addition to any other purposes described in this document and in the Cookie Policy, if available.
The User assumes responsibility for the Personal Data of third parties obtained, published, or shared through this Application and declares that they have the right to communicate or disclose them, thus relieving the Data Controller of any liability towards third parties.
Methods and place of processing the collected Data
Processing methods
The Data Controller adopts appropriate security measures to prevent unauthorized access, disclosure, modification, or destruction of Personal Data.
Processing is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. In addition to the Data Controller, in some cases, the Data may be accessible to certain types of persons in charge, involved with the operation of this Application (administration, sales, marketing, legal, system administration) or external parties (such as third-party technical service providers, mail carriers, hosting providers, IT companies, communications agencies) appointed, if necessary, as Data Processors by the Data Controller. The updated list of these parties may be requested from the Data Controller at any time.
Legal basis of processing
The Data Controller processes Personal Data relating to the User if one of the following applies:
the User has given consent for one or more specific purposes; Note: Under some legislations, the Data Controller may be allowed to process Personal Data until the User objects to such processing (“opt-out”), without having to rely on consent or any other of the following legal bases. This, however, does not apply, whenever the processing of Personal Data is subject to European data protection law;
processing is necessary for the performance of a contract with the User and/or for any pre-contractual obligations thereof;
processing is necessary for compliance with a legal obligation to which the Data Controller is subject;
processing is related to a task that is carried out in the public interest or in the exercise of official authority vested in the Data Controller;

The User has the right to obtain information regarding the legal basis for the transfer of Data outside the European Union or to an international organization governed by public international law or formed by two or more countries, such as the UN, as well as information regarding the security measures taken by the Data Controller to protect the Data.
The User can verify whether one of the described transfers takes place by examining the section of this document regarding the details of Personal Data processing or by contacting the Data Controller at the contact information provided at the beginning.
Retention period
The Data is processed and stored for the time required for the purposes for which it was collected.
Therefore:
Personal Data collected for purposes related to the performance of a contract between the Data Controller and the User will be retained until the completion of such contract.
Personal Data collected for purposes related to the legitimate interests of the Data Controller will be retained until such interests are fulfilled. The User can obtain further information regarding the legitimate interests pursued by the Data Controller in the relevant sections of this document or by contacting the Data Controller.
When the processing is based on the User’s consent, the Data Controller may retain Personal Data for a longer period until such consent is revoked. Furthermore, the Data Controller may be obliged to retain Personal Data for a longer period in compliance with a legal obligation or by order of an authority.
At the end of the retention period, Personal Data will be deleted. Therefore, upon expiration of this period, the right to access, delete, rectify, and the right to data portability cannot be exercised.

User Data is collected to allow the Data Controller to provide the Service, comply with legal obligations, respond to requests or enforcement actions, protect its rights and interests (or those of Users or third parties), detect any fraudulent activities, and for the following purposes: Contacting the User, Statistics, Displaying content from external platforms, and Platform and hosting services.

Users may exercise certain rights regarding the Data processed by the Data Controller.
In particular, the User has the right to:
– Withdraw consent at any time. The User can revoke the consent to the processing of their Personal Data previously given.
– Object to the processing of their Data. The User can object to the processing of their Data when it is carried out on a legal basis other than consent. Further details about the right to object are provided in the section below.
– Access their Data. The User has the right to obtain information about the Data processed by the Data Controller, certain aspects of the processing, and receive a copy of the processed Data.
– Verify and request rectification. The User can verify the accuracy of their Data and request its update or correction.
– Obtain the limitation of the processing. When certain conditions are met, the User can request the limitation of the processing of their Data. In such cases, the Data Controller will not process the Data for any other purpose than their storage.
– Obtain the erasure or removal of their Personal Data. When certain conditions are met, the User can request the erasure of their Data by the Data Controller.
– Receive their Data or have it transferred to another controller. The User has the right to receive their Data in a structured, commonly used, and machine-readable format, and, where technically feasible, to have it transferred to another controller without hindrance. This provision is applicable when the Data is processed by automated means and the processing is based on the User’s consent, a contract in which the User is a party, or contractual measures connected to it.
– Lodge a complaint. The User can lodge a complaint with the competent data protection supervisory authority or take legal action.

When Personal Data is processed for public interest purposes, in the exercise of official authority vested in the Data Controller, or for the legitimate interests pursued by the Data Controller, Users have the right to object to the processing for reasons related to their particular situation.
Users are reminded that if their Data is processed for direct marketing purposes, they can object to the processing without providing any justification. To find out if the Data Controller processes data for direct marketing purposes, Users can refer to the respective sections of this document.
How to exercise rights
To exercise the User’s rights, Users can submit a request to the contact details of the Data Controller indicated in this document. Requests are free of charge and processed by the Data Controller as soon as possible, in any case within one month.

Legal defense
The User’s Personal Data may be used by the Data Controller in court or in the preparatory stages leading to possible legal action arising from its improper use or related services used by the User.
The User declares to be aware that the Data Controller may be required to reveal Personal Data upon request of public authorities.
Specific information
Upon the User’s request, in addition to the information contained in this privacy policy, this Application may provide the User with additional and contextual information about specific services or the collection and processing of Personal Data.
System logs and maintenance
For operation and maintenance purposes, this Application and any third-party services it uses may collect system logs, which are files that record interactions and may also contain Personal Data, such as the User’s IP address.

Additional information related to the processing of Personal Data may be requested at any time from the Data Controller using the contact information.
Response to “Do Not Track” requests
This Application does not support “Do Not Track” requests.
To determine whether any third-party services used support them, Users are advised to consult their respective privacy policies.
Changes to this privacy policy
The Data Controller reserves the right to make changes to this privacy policy at any time by notifying Users on this page and, if possible, within this Application, as well as by sending a notification to Users through one of the contact details available. Therefore, please regularly check this page, referring to the last modification date indicated at the bottom.
If the changes affect processing activities based on consent as the legal basis, the Data Controller will collect the User’s consent again, if necessary.
